General Terms and Conditions of Sale

Preamble   

These General Terms and Conditions of Sale (hereinafter "GTC") govern the sales of products made on the website www.zagecolorfullife.com by the micro-enterprise Zage Colorful Life with consumers. 

The products offered are clothing accessories, including fanny packs and handmade accessories (hereinafter the “Products”).   

Article 1 – Purpose 

These Terms and Conditions define the rights and obligations of the parties in connection with the online sale of Products offered on the website. Placing an order implies full and unreserved acceptance of these Terms and Conditions by the Customer. 

Article 2 – Client 

The Products are offered for sale by a professional exclusively to natural persons acting as consumers, within the meaning of the Consumer Code, having full legal capacity. 

Article 3 – Products   

3.1 Characteristics   

The essential characteristics of the Products are described as accurately as possible on Product descriptions . Photographs are for illustrative purposes only and are not contractually binding, particularly due to the handcrafted nature of the products. 

3.2 Availability   

Products are offered subject to availability. As the creations are made from small pieces of fabric, quantities are limited and some models may not be repeated. 

Article 4 – Order  

The Customer follows the online ordering process and definitively confirms their order after accepting the Terms and Conditions. Any confirmed order constitutes a firm and final sales contract. The Customer is responsible for the accuracy of the information provided (in particular the address). (sending) . 

An order confirmation is sent by email. 

 

Article 5 – Price and payment   

5.1  Price 

Prices are shown in euros including VAT. Delivery costs are specified before order confirmation. Zage Colorful Life reserves the right to change its prices at any time, without affecting orders already confirmed. 

5.2 Payment  

Payment is made online by credit card or PayPal. Full payment is due at the time of order. Transactions are secured through the payment services offered by Shopify and PayPal. 

 

Article 6 – Delivery  

6.1 Delivery Zones  

Zage Colorful Life offers delivery of Products in France  and in Europe . 
Certain restrictions may apply to certain destinations, particularly due to logistical or regulatory constraints.  

6.2 Processing and shipping times  

Orders are processed within an estimated timeframe of 3 business days  after receipt of payment.  

This processing time is in addition to the manufacturing time of 3 to 5 days. * , as well as the carrier's delivery time.  

  • During peak periods, public holidays , and vacation periods or in exceptional circumstances, processing delays may occur. 
    Zage Colorful Life undertakes to inform the Client as soon as possible in the event of a significant delay.  


6.3 Delivery methods and costs  

The Products are shipped via the following delivery methods:  

  • Colissimo  

  • Colissimo Pickup Point  

  • Mondial Relay Home delivery, Pickup point, Looker  

  • Tracked letter  

  • International tracked letter  

  • Chronopost Shop 2 Shop  

  • Chronopost International  

  • Delivengo  

Delivery costs vary depending on the delivery method chosen, the weight of the order, the destination and the carrier's current rates. 
The exact costs are indicated to the Customer before final order confirmation.  

6.4 Shipment tracking  

For most delivery methods, a tracking number  is communicated to the Client by e-mail once the order has been shipped. 
The Customer can track the delivery of their parcel directly on the website of the carrier concerned.  

6.5 Customer Responsibilities  

The Customer is required to provide delivery information  accurate and complete  when placing an order. 
Zage Colorful Life cannot be held responsible for any failure or delay in delivery resulting from incorrect or incomplete information provided by the Customer.  

The customer will have to pay for a redelivery in the event of an incomplete address or incorrect if he wishes to proceed with sending his order.  

For deliveries outside mainland France, the Customer is responsible for verifying the customs and import rules applicable in their country. 
Any additional customs duties, taxes or fees remain the sole responsibility of the Customer.  

6.6 Delivery problems  

In case of delivery problems, damaged packages or non-receipt, the Customer is asked to contact Zage Colorful Life as soon as possible by e-mail .  

Delivery times may vary depending on the destination, weather conditions, strikes, or any other circumstance beyond the control of Zage Colorful Life , they are indicated for guidance purposes only .  

6.7 Parcel not collected from collection point  

When the Customer chooses a delivery method to a relay point, it is their responsibility to collect their parcel within the time limits set by the carrier.  

Any package not collected within this timeframe will be automatically returned to the sender.  

The refund for the Product can be made only after actual receipt of the package by Zage Colorful Life , and will be realized deducting the initial delivery costs and return costs .  

Since the return time to sender is entirely managed by the carrier, it is independent of the will of Zage Colorful Life and can, in some cases, take several weeks.  

 

Article 7 – Receipt, Conformity and Defective Products  

The Customer is required to check the condition and conformity of the Products upon receipt.  

In the event of a damaged, defective, or non-conforming Product, the Customer must contact Zage Colorful Life as soon as possible by e-mail at the address zage.colorfullife@gmail.com .  

To facilitate the processing of the request, Zage Colorful Life may request photographs or any supporting evidence to establish the defect or non-conformity of the Product.  

In the event of a proven defect or error attributable to Zage Colorful Life, the return costs will be covered by the latter and a suitable solution will be offered (replacement or refund).  

 

Article 8 – Right of withdrawal and returns  

8.1 Right of withdrawal  

In accordance with Articles L.221-18 et seq. of the Consumer Code, the Customer has a period of 14 calendar days  from the date of receipt of their order to exercise their right of withdrawal and request a return for eligible Products.  

8.2 Products eligible and ineligible for return  

Returned products must be:  

  • In their original state,  

  • No used,  

  • No damaged  

  • And returned in their original packaging.  

The following are not eligible for the right of withdrawal:  

  • THE Products made according to the Customer's specifications or customized (choice of fabrics, colors, dimensions, specific options), except in the case of non-conformity or error attributable to Zage Colorful Life;  

  • Products with minor aesthetic defects clearly described on the product sheet and accepted by the Customer when ordering, without impact on their conformity or use.  

8.3 Return Procedure  

To initiate a return request, the Customer must contact Zage Colorful Life by e-mail at the address zage.colorfullife@gmail.com .  

Detailed return instructions, including the return address, will be provided via email.  

Return shipping costs are the responsibility of the Customer, except in cases of defect, non-conformity, or error attributable to Zage Colorful Life.  

It is strongly recommended to make the return with a valid tracking number.  

8.4 Reimbursement  

After receiving and inspecting the returned product, the refund will be processed. A maximum of 14 days after notification of withdrawal , with the possibility of waiting for receipt of the product.  

The refund will be made via the payment method used when ordering, unless expressly agreed otherwise between the parties.  

Article 9 – Legal Guarantees   

The Products benefit from the legal guarantees of conformity (articles L.217-3 et seq. of the Consumer Code) and of hidden defects (articles 1641 et seq. of the Civil Code). 

Article 10 – Liability 

The responsibility of Zage Colorful Life cannot be held liable in the event of misuse of the Products or failure to comply with maintenance instructions. 

Article 11 – Force majeure   

The responsibility of Zage Colorful Life cannot be held liable in the event of a force majeure event preventing the performance of its obligations.   

Article 12 – Mediation   

In accordance with Articles L.612-1 et seq. of the Consumer Code, the Customer may have recourse, free of charge, to a mediator of the consumption 

Article 13 – Amendment to the General Terms and Conditions of Sale   

Zage Colorful Life reserves the right to modify these General Terms and Conditions of Sale at any time by publishing a new version on the Website. The applicable Terms and Conditions are those in effect on the date of the order. 

Article 14 – Applicable Law and Jurisdiction 

These Terms and Conditions are governed by French law. 
However, the consumer Client benefits from the mandatory legal protection provisions of their country of residence. 
In the event of a dispute, the Client may bring the matter before either the competent French courts or those of his place of residence.
